The government itself will formulate a separate law that will regulate marketplaces. As stated in the final report of the FAS on the development of competition for 2023, the service will develop such a project together with the Ministry of Industry and Trade, Rospotrebnadzor, and other departments and organizations. In their work, the authorities will rely on the recommendations of the Federation Council Committee on Economic Policy and the instructions of the Cabinet of Ministers. The FAS has already prepared a concept for the future bill. Its provisions are aimed at regulating relations between marketplaces, buyers, sellers of goods, and owners of order pick-up points (OPPs). The document itself will be developed to "create more effective conditions for competition and protect the rights of consumers and entrepreneurs in the field of e-commerce."

The FAS press service clarified to Izvestia that the agency believes that the issue of regulating the activities of marketplaces should be considered in a separate federal law that will take into account the specifics of the work of all parties.

— Marketplaces are not trading organizations, they do not sell goods, their relations with buyers, sellers and pick-up points differ significantly from relations in the network structure, — the FAS emphasized. — In this regard, the service considers it necessary to establish requirements for marketplaces that are different from those imposed on retail chains.

The Ministry of Industry and Trade and Rospotrebnadzor noted that they have not yet received the concept of the document from the antimonopoly service. Izvestia sent a request to the Federation Council and the government about what recommendations and instructions have already been given to the departments to create a new bill.

If the government drafts its own bill, it will not be the first on this topic. Two similar documents have already been submitted to the State Duma, and they were criticized by experts from the Presidential Prosecutor General's Office. Thus, in the first one, deputies from several parties at once (United Russia, A Just Russia, LDPR) proposed to limit marketplaces in selling goods if their revenue exceeds 150 billion rubles, oblige them to be responsible for the quality of the products sold, and also prohibit them from changing the terms of contracts more often than once a year. These standards were developed jointly with the Ministry of Industry and Trade.
